With increase in foreclosures many judges of the Supreme Court are now no longer rubber stamping foreclosures without scrutiny. This is something new to the banks and lenders. Justice Arthur Schack is noted for turning down foreclosure petitions because of careless and shoddy documentation by those filing for foreclosure.

Recently Justice Timothy Walker (Buffalo) refused to take foreclosure action in a suit brought by Wells Fargo because in the modification the bank had insisted on including the clause referring to adjustable rate ignoring the wide criticism that this move has generated. In a previous order the judge had asked the bank to offer the loan sans this clause.

In Suffolk County – where 1/14th of the population of New York State reside but which is accounting for 1/6th of all new foreclosure filings, Justice Jeffrey Arlen Spinner has become a celebrity for his stern rulings favouring the house owners in a swath of foreclosure cases.

Spinner was the presiding judge in a meeting – Residential Mortgage Foreclosure Conference he had supervised the efforts of Suffolk County to tackle the foreclosure attack by putting into force new procedures of the court and managing the compulsory settlement talks for the sub-prime mortgages.
